The Good Law Project Update 13 November


Good Law Project's challenge to the Equality and Human Rights Commission's (EHRC) interim guidance has begun in the High Court.

The guidance was published only nine days after the Supreme Court decision on the definition of sex under the Equality Act on 25 April. The EHRC issued a series of updates to the guidance, before withdrawing it entirely and deleting it from its website on 15 October.

Good Law Project, working with Leigh Day alongside three individual claimants whose lives have been upended by the guidance, argues that the guidance was rushed, legally flawed, and overly simplistic. We say the commission got the law wrong by suggesting that single-sex provision, such as women's toilets, must be made on a trans-exclusionary basis.

The Court has adjourned for the day.

We had a good hearing – and the judge listened carefully to our points. Because of what's at stake, the Judge wants to think about his decision. We'll let you know as soon as we know more.

I think it's significant that the EHRC withdrew their guidance last month. That tends to suggest that they think they got it wrong. But we'll see!

This ruling is causing me so much distress. If I can't find neutral or disabled toilets I just hold it in until later. Making it very difficult. Did use toilets in a restaurant but make sure there is no one else around. Anxiety is up high.

I did donate to this challenge so hope we get success. Just makes our defense much more firm.

I take no notice and use the ladies, no problem so far. Quite prepared to drop my knickers and say look female!!!!

Yeah, I take no notice either, not that it matters here in Australia and it has never been a problem for me.  When I changed my life around, I used the appropriate toilets.

Yes, this.  While things are good here right now, we do have people wanting political power who would love to make bathroom access a problem for us.  I made sure that all my documentation was updated: driver's license, passport and birth certificate all say female.  As would dropping my knickers.  If things got bad enough, I would destroy my original birth certificate, to make it harder for them to find evidence.

As above, I take absolutely no notice and use the Ladies.

However, I do understand those for whom this represents a significant anxiety.

I don't feel like I pass enough to use the ladies is one issue tbh. In a dress I kinda at a distance might get away with it. But honestly I wish I wasn't worried. I hate confrontation though.
