Yesterday, the Supreme Court once again limited trans rights, ruling that states may exclude trans students from playing sports consistent with their gender identity. In the wake of the ruling, trans politicians, activists, and more spoke up about the court's decision to once again harm trans youth.

In a decision in the cases West Virginia v. B.P.J. and Little v. Hecox, the justices ruled 9-0 that anti-trans sports laws for schools did not violate Title IX protections against discrimination, and 6-3 that they also did not violate the Equal Protection Clause of the Fourteenth Amendment.  Justice Sonia Sotomayor, joined by Justices Elena Kagan and Ketanji Brown Jackson, wrote a partial dissent, insisting that the Equal Protection Clause aspect of the case should have been sent back to the District Court for further litigation with additional evidence.

Rep. Sarah McBride (D-DE), the first openly trans member of the House of Representatives, lamented on Bluesky that the decision denied trans youth a key life experience purely on the basis of their gender identity.

"Transgender Americans want the same things as every other American: the freedom to build a good life, earn a livable wage, and fully participate in their communities — including, for many, the camaraderie, discipline, and sense of belonging that come from sports," McBride wrote. "The Supreme Court's disappointing decision upholds blanket bans that deny transgender Americans the individual dignity and fairness that all of us deserve."

Sadly, this will require an Act of Congress to fix. They need a law against discrimination that specifies that it applies to Executive Orders, all Titles, Amendments, federal and state agencies, as well as any commercial enterprise operating within the U.S.

Somehow, I am not convinced it will happen.
