The Human Rights Campaign Foundation (HRCF) filed a class-action lawsuit in federal court on Monday against the Trump Administration's Office of Personnel Management (OPM), challenging its decision to prohibit insurance companies from covering gender-affirming care for federal employees and their families.
"Our message to the Trump administration is simple: We'll see you in court," said Kelley Robinson, president of HRCF, in a statement. "Healthcare access should never be weaponized to advance discrimination — and the denial of coverage for critical healthcare based simply on who you are blatantly violates the rights of all of us.
The lawsuit is the latest step against OPM's policy blocking insurers from providing coverage for gender-affirming care for those enrolled in the Federal Employee Health Benefits (FEHB) or Postal Service Health Benefits (PSHB) programs.
Noting the life-saving nature of gender-affirming care, the lawsuit draws a comparison with more widely accepted life-saving care: "This categorical denial of treatment for those who require continuing gender-affirming care is akin to denying continuing insulin treatment for someone with diabetes."
OPM issued a letter in August 2025 instructing insurers to no longer provide coverage for federal employees, effectively stating that if they included such coverage, their contracts would not be renewed. That policy took effect when plans renewed on January 1st of this year.
