Single-sex spaces open to the public, such as toilets and changing rooms, should be organised based on biological sex, according to official guidance that has come into force.

The code, published by Equality and Human Rights Commission (EHRC), says trans people should use either gender-neutral facilities or the ones that match their biological sex, in places such as gym changing rooms or rape crisis centres.

The guidance was published in June but is now in place in England, Wales and Scotland - despite opposition among some MPs.

It comes 16 months after the UK Supreme Court ruled "sex" in equality law means "biological sex" rather than the gender someone identifies as.

The law does not apply to individuals, only to service providers. There is no law stopping you use any gendered facility you wish.

If asked by the service provider to comply then in theory you should, but its not highly enforceable unless they have SIA badged security- then best to get out. Otherwise you're done and out by the time anything could be done.

It's not deemed proportional to exclude a trans person without offering a suitable alternative. If asked not to use your preferred gender space, then request a 3rd space alternative. Directing you to use the other gender space and not offering a 3rd space would be discriminatory without a strong reasoning. This would be hard to uphold for general places like bathrooms, changing rooms etc.

Also remember, no civilian has the right to confront you or prevent you from entering (or leaving) a restroom.

If a civilian demands that you prove your identity, they're the one who is actually breaking a law.

Proportionate self defense is your right. If you are touched or grabbed you can strike back.

The problem with declaring space to be used according to "biological sex" is that there is no consensus as to what that means. Rarely do such facilities have DNA testing readily available, and the results wouldn't be in before you wet yourself.

However, if they are referring to "biological function," it might make more sense. For example, if you stand to pee, use the urinals over there ----->.

Part of the problem is that not all trans people transition surgically, yet still need to pee and cannot do so shoulder-to-shoulder with the smelly guys from the locker room, nor should they be forced to.

Until the powers that be can learn that gender has nothing to do with anatomy, this issue will be staying around.

It has been defined Lori, the court says if you weren't born a woman you should not be in there. The whole thing is typical UK beaurocratic nonsense. You aren't breaking a law by using the ladies (or mens for FTM), you cannot be arrested, You could be reported to the facility manager who than has the right to ask you to leave but it is up to them whether they do. By the time they get around to responding to any report you will have finished and left and been on your merry way, assuming you haven't fallen victim to a dodgy curry from the night before! If you receive targeted abuse from another woman (highly unlikely) then they ARE breaking the law and they CAN be arrested.

I can however see problems at changing facilities at swimming baths, gyms etc once staff become aware that you are trans. I can also envisage situations where employers might have to react if female staff report you but that is ripe for legal challenges based on discrimination I would think. The whole thing could be sorted by changing the wording of the Equalities act, something entirely within the power of the government. They won't do it though as it won't win them any votes.

In all honesty just go in, do your business and get on with your day. The amount of money lawyers will be making off this nonsense is insane, let them get on with it.

In all honesty Liz, most people probably haven't even heard of the changes never mind care enough to say anything. It is a massive issue for us but just a footnote in the news for everyone else.

Don't think I'll attempt a changing room until I've had my GRS. Just would not feel confident enough!

I wonder what NHS will do with hospital wards. I ever end up on male one, I'll discharge myself and take my chances!

I think they have to find you a seperate room don't they? They aren't allowed to shove you on a male ward anymore than they can put you on a female ward. Will probably mean getting shoved in the janitors closet knowing the NHS!

No problems today in JD Sports unisex changing room. No toilet cops either ( I  use the disabled as there's much more space and I feel more comfortable).

I use disabled where available or just hold it in. Will only use women's if its empty or in a place with people I expect are more educated
