McInerney Murder Case: Mistrial
By Neal Broverman
http://www.advocate.com/News/Daily_News/2011/09/01/Jury_Hung_in_King_Murder_Trial,_Report_Says/A judge has declared a mistrial in the two-month-long case against 17-year-old old Brandon McInerney, who shot gay teenager Lawrence King twice in the head in February 2008.
The jury couldn't decide whether to convict McInerney as an adult of first-degree murder, with hate crime charges, or of voluntary manslaughter. The former charge would have netted McInerney at least 53 years in prison, the latter only about 20. The Los Angeles Timesreports that the last jury vote was 7 to 5 in favor of a manslaughter conviction. The Ventura County District Attorney's office could now refile murder charges in an attempt to get the case retried or offer McInerney another plea deal. The Ventura County Star reports that a past offer of 25 years to life was rejected by McInerney's defense team.

Seven jurors thought he was guilty of voluntary manslaughter while five thought he was guilty of murder. The lone juror who spoke to the media — but didn't give his name — said the fact that McInerney was 14 at the time of the shooting at E.O. Green School was a big point of contention as the jurors deliberated his fate during the past five days.

http://www.edgeboston.com/news/crime///124114/mistrial_declared_in_ca_gay_student_killingAt the outset, prosecutors presented it as a slam-dunk case of murder: Brandon McInerney, driven by homophobic rage, shot a gay classmate in the back of the head during a school class.
But ultimately, after an eight-week trial and six days of deliberations, jurors could not decide if the slaying was murder or manslaughter.
