ALBANY —

A report released Wednesday by the New York Civil Liberties Union documents discrimination and harassment against transgender people and urges the state Senate to pass the Gender Expression Non-Discrimination Act, known as GENDA, which passed the Assembly on Monday.

The report, prepared with the help of the Fordham University School of Law faculty and students, builds upon recent momentum following a precedent-setting federal ruling by the Equal Employment Opportunity Commission two weeks ago that set a legal precedent prohibiting workplace discrimination against transgender people.

With the New York State Assembly's passage of a transgender civil rights law –– for the fifth time –– on April 30, hundreds of LGBT community advocates are headed to Albany on May 8 for the Empire State Pride Agenda's (ESPA) annual Equality & Justice lobbying day.

A key goal will be to push the Republican State Senate majority –– which last June allowed a vote on marriage equality and provided four supporters critical to its success –– to break the logjam that has stalled the Gender Expression Non-Discrimination Act for nearly a decade.

"GENDA is our number one priority," said Lynn Faria, ESPA's interim executive order.

New Yorkers are legally protected against discrimination based on race, sex, sexual orientation, or disability -- which means people who fall under any of those categories cannot lose access to homes, jobs, and other services because of their racial, sexual, or physical identities.

Currently, however, there are no protections for New Yorkers who are transgender or express their gender differently from societal expectations and stereotypes.

And according to the New York Civil Liberties Union, which is pushing to change the discrimination laws to include this group, New York state is falling behind.

This week, the NYCLU released a report documenting discrimination in the state for transgender and gender non-conforming New Yorkers.
