The American Civil Liberties Union of Illinois has announced a new proposed court agreement expected to solidify a small but important gain for transgender people wishing to change their birth certificates.

Under new rule, transgender people are allowed to update the gender markers on their birth certificates without having to undergo genital surgery. The new mandate still requires proof of gender-related surgery.

The ACLU sued the Illinois Department of Public Health (IDPH) on behalf of three trans people last May, claiming that IDPH placed unfair and costly burdens on trans people by requiring proof of genital surgery in order to change their birth certificates.
