UK made the changes to its domestic-partner plan to comply with Attorney General Greg Stumbo's opinion that deemed the previous plan (and one at the University of Louisville) unconstitutional because it too closely defined a domestic partnership in terms that resembled a marriage. Stumbo said that violated an amendment to the state constitution that defined marriage as being between a man and a woman.

Stumbo said UK and U of L could comply with the marriage amendment by expanding eligibility for the benefits.
