ACLU Sues Michigan Over Transgender Driver's Licenses

The state of Michigan is being sued over its refusal to change gender identities on driver's licenses without a new birth certificate.

The American Civil Liberties Union of Michigan is representing six transgender people who no longer recognize their birth gender. But the ACLU says the secretary of state won't allow them to change their license unless they present an amended birth certificate.

The state says birth certificate needs to be changed to change Driver's License and in Michigan, birth certificate can only be changed after SRS. According to the story, other states do not allow birth certificates to be changed which means people born out of state cannot get DL changed, even with SRS. SRS is not required to change passport. Is there a way to standardize requirements across all states? At what stage of transition should gender markers be allowed to be changed?

Wow. They're fighting this on equal protection grounds, free expression grounds, privacy grounds, and freedom to travel. They're really throwing the kitchen sink at this one. I hope something sticks.

If I were writing the law, I'd require a signed affidavit from the recipient swearing that they intend to live as the new gender. I can't imagine why they'd need anything else.

While that would be awesome, I'm expecting the final policy to align with the Federal government's policy for updating gender marker on passports (a doctor's note).
