A person who has physically and legally changed his or her sex should be able to marry a member of his or her former sex under Texas law. Under Texas law, marriage consists "only of the union of one man and one woman." Therefore, if a transgendered individual formerly male has legally changed his sex and entered into a union with a man, Texas law should recognize that union as a marriage, and the University should provide benefits.
