Rehoboth Beach lifeguards summoned police assistance late Saturday afternoon for a group of transgender men who had their breasts exposed.

The incident happened near the surf off Queen Street around 4:45 p.m. "We have like a bit of an odd problem," the lifeguard reported over the radio. "There are girls on our beach without tops," he continued. "Well there apparently they are transgender and they have female breasts and a [incomplete sentence]. We tried to tell them to put shirts on and they told us they are transgender so that it's illegal to discriminate and I just had a problem with it and that's where we're at right now," he added.

If they had breast implants as the article suggests, I agree with having to cover up.

The article seemed to have trouble with pronouns and whether they were trans men or transwomen.

According to the ordinances women are required to cover up, period.

Quote§ 198-12 Indecent exposure.
[Amended 8-13-1993 by Ord. No. 893-2]

A. A male is guilty of indecent exposure if he exposes his genitals or buttocks under circumstances which he knows his conduct is likely to cause affront or alarm to another person.

B. A female is guilty of indecent exposure if she exposes her genitals, breasts or buttocks under circumstances which she knows her conduct is likely to cause affront or alarm to another person.

§ 198-13 Topless bathing suits prohibited.

No female over the age of five years shall wear a topless bathing suit or otherwise fail to cover her breasts with less than a full opaque covering of any portion thereof below the upper portion of the nipple.

I read that Janet, if they had top surgery, it shouldn't matter. If top surgery and legally male, then there is no case for covering up. We don't know the details and the article title is misleading.

REHOBOTH BEACH, Delaware - Rehoboth Beach lifeguards requested police assistance late Saturday afternoon for a situation involving a group of transgender men who had their breasts exposed according to a report by the Rehoboth Weekend Update.

The on-line publication reported that the incident happened by the surf near Queen Street around 4:45 p.m.

The report says that a lifeguard reported having an 'odd problem' involving 'girls' on the beach with their tops off.

Rehoboth Beach and the local Internet have been buzzing for days after a few transgendered men caused a stir on the beach over the holiday weekend by removing their tops and revealing their enhanced breasts.

Police there were called to the beach after lifeguards requested that the sunbathers replace their tops.

"Passers-by came up to the lifeguard and said they were alarmed and unhappy with the females showing their breasts," Police Chief Keith Banks said. "The lifeguard responded and saw that they were males."

REHOBOTH BEACH -- An indecent exposure incident that caused a stir in the city and made national headlines has called attention to the contradictory legal status of transgendered individuals.

Police Chief Keith Banks said officers were called to the beach near Queen Street at about 4:40 p.m. May 29, where several individuals with male genitalia and breast implants were standing topless.

After officers explained their behavior was disruptive to other beachgoers, Banks said the individuals covered up and no citations were issued.

"If they identify themselves as women, we respect that," he said. "But if they choose that gender, they should follow that gender's rules."
