Rehoboth Beach isn't a topless one, but a few transgender women decided to go a little wild Memorial Day weekend and showed  their surgically enhanced breasts off in the afternoon sun.

Because the ladies still have male genitalia, no laws were broken, say police.

Other beachgoers didn't like the daytime strip show and, thinking the free-wheeling beachgoers were full-blown women, observers complained to a lifeguard.

A small group of transgender women who went topless over the Memorial Day weekend in Rehoboth Beach, Delaware have created a stir.

Beachgoers in the small – and gay-welcoming – seaside town complained to lifeguards about the topless women. The pre-operative transgender women initially refused to cover up, but complied once police arrived.

Police say the women would not have been arrested under the city's indecent exposure law because they did nothing illegal.

Topless transgender men at Rehoboth Beach in Delaware drew complaints from beachgoers last weekend for baring their surgically enlarged breasts, according to Fox News.

But the guys aren't lawbreakers, says Police Chief Keith Banks. They can't be charged with indecent exposure for showing off their breasts because they have male genitalia.

Shirtless men, explains Banks, are not subject to the town's ban on going topless, just shirtless women. A specific law is not needed to cope with the issue, he adds.

A group of topless sunbathers in Rhode Island is giving local law enforcement a lesson in gender identity and its complex relationship with legal definition of sex and "indecency."

Since the sunbathers are legally considered male, their actions were not illegal.The double standards inherent in public indecency laws are highlighted by this case, as well as recent cases of online censorship of topless transgender men who have had chest reconstruction (thereby no longer possessing "breasts").

Indecent exposure incident underlines 'ridiculous' standards

REHOBOTH BEACH -- An indecent exposure incident that caused a stir in the city and made national headlines has called attention to the contradictory legal status of transgendered individuals.

Police Chief Keith Banks said officers were called to the beach near Queen Street at about 4:40 p.m. May 29, where several individuals with male genitalia and breast implants were standing topless.

After officers explained their behavior was disruptive to other beachgoers, Banks said the individuals covered up and no citations were issued.
