I don't live in Virginia but I was born there and have been getting mixed answers on what is needed to change it. If it is SRS, will I need an amended birth certificate in order to change my license here in Florida? I am not planning on going through with surgery and for some reason this all just clicked, leaving me worried. Anyone know? Thanks :)

If I understand the question correctly, it is more rather Florida will issue a new drivers license without an amended birth cert.

I am from Virgina and living in Virginia, so I have looked into this a bit and from my understanding, there needs to be some sort of physicians affidavit for permanent irreversible gender surgery, exactly what that surgery would have to be is however, seems to be a bit more vague. It says 'gender surgery' but, would a hysto or an orchi be covered under that term, or only more complete  surgeries? I doubt anything would be challenged in court though as long as the procedure was surgical in nature.

Here is the relevant law:
QuoteAdministrative Code: 12 Va. Admin. Code ยง 5-550-320 (2006).

5-550-420 Change of Sex. Except as provided in subdivision 3 of 12 VAC 5-550-450 [concerning intersex conditions], upon presentation of acceptable evidence (preoperative diagnosis, postoperative diagnosis and description of procedure) and a notarized affidavit from the physician performing the surgery, a new certificate of birth may be prepared by the State Registrar for a person born in this Commonwealth whose sex has been changed by surgical gender reassignment procedure. A certified copy of the court order changing the name of the registrant as well as designating the sex of the registrant must be in the possession of the State Registrar together with a request that a new certificate be prepared.

Hikari, thanks for the info :) I guess I just don't understand most of it. My main worry is that they will not change my license without an amended birth certificate, yes. I have some friends who have gone through the surgeries and legally got it all changed but I guess I will soon be asking them if they had to change their birth certificate first. I never gave thought to the fact that being born in another state might make things more complicated. That law does sounds a little vague. I guess when it comes to my dl I might just have to go down to the dmv and ask them. As far as the birth certificate I might just have to call around from here to find out. I'm not yet even on T but I want to understand it all so that I can start planning and learning what I need to do.

Hi Hikari, hi Alexander,

I live in Virginia as well.  Check out TransRightsVA@yahoogroups.com.  They can answer your questions about the BC change.  Most everyone that I know has had GRS or is in transition.  But hopefully our AG won't screw things up.
