Judge finds in favor of Orono schools over transgender girl's use of bathroom

BANGOR, Maine — A Superior Court judge on Tuesday r uled in favor of the Orono schools and against the parents of a transgender child who in 2007 was forced to stop using the girls bathroom and told to use a staff bathroom after the grandfather of a male student complained.

Justice William Anderson granted summary judgment to Riverside RSU 26, formerly the Orono School District.

"The court is not unsympathetic to [the girl's] plight, or that of her parents," Anderson wrote in his 26-page opinion. "It is no doubt a difficult thing to grow up transgender in today's society. This is a sad truth, which cannot be completely prevented by the law alone. The law casts a broad stroke where one more delicate and refined is needed. Although others mistreated [the girl] because she is transgender, our Maine Human Rights Act only holds a school accountable for deliberate indifference to known, severe and pervasive student-on-student harassment. It does no more.

"In this case, the school acted within the bounds of its authority in prohibiting [the girl] from using the girls' restroom; it did not itself harass [the girl] by its actions, and it was not deliberately indifferent to the harassment that [she] experienced from others," the judge concluded.
"The court finds that there is no evidence of deliberate indifference with respect to plaintiff's claims of education discrimination, and it finds that defendants acted within the law under the public accommodation discrimination claim. Therefore, the court grants summary judgment to [the school district]."

Ok, what really happened here?

Because, either some kid got more than he bargained for while playing peeping Tom or this is just organized bullying.

GLAD to Appeal Ruling in Case of Transgender Girl Discriminated Against at School

Today, a Maine trial court judge dismissed the case of a transgender girl who experienced discrimination and harassment at her Orono school. GLAD, which is representing the student in the lawsuit, announced it will immediately appeal the decision.

"Our client Susan Doe is a transgender girl who was made an outcast by school officials and was subjected to severe bullying over the course of two years simply because of who she is, in violation of Maine anti-discrimination law," said GLAD Senior Attorney Ben Klein, who argued in the case on behalf of the student. "The judge is wrong on the law and ignored critical facts in making his decision."

"We will appeal this decision," said Jennifer Levi director of GLAD's Transgender Rights Project. "We always knew that the trial court was just the first step and that this lawsuit would ultimately be decided by Maine's highest court. "Under Maine law, a transgender girl – whom the school acknowledged is a girl – needs to be able to live consistent with her gender. The school acknowledged that Susan could not otherwise progress in her academic development."

He lives with his grandfather.  When he told his grandfather that "a boy" uses the girl's room, his grandpa decided to put his politics and morals into play and told his grandson to go in there after she does, since if she had the right to use the "wrong" bathroom, so did his grandson.

The school's response was to punish the victim grandfather/grandson were bullying.  The court didn't find anything legally wrong with doing that.  :(  Ironically, none of the girls seemed to have a problem with a girl in the girl's room.  Imagine that.
