That distinction is what saved the law in the eyes of the SCOTUS (otherwise the other ways the tax code is used to encourage people to buy certain things would then be of questionable constitutionality).

Levying a tax if someone doesn't buy a product or service is still force.  It's just a sneaky underhanded way of forcing it.
