Missouri Gender Marker and DL Changes Pre-Op!

Dear Susan or to whom it may concern,

Mo. Ann. Stat. § 193.215(9) was officially invalidated via court orders 13AR-CV00157 and 13AR-CV00240. I have virtual copies of the orders so that you can make the appropriate notifications and changes in policy. Furthermore, I also have the original "templates" if you are interested in circulating them to those in need of the "official" precedent order forms.

In regard to the templates, they should be filed separately for two different court appearances (or for the same appearance with the name change docketed first) and should be ordered as such... 1) for the first order: name hearing notice, name change petition, name change judgement, and the order of publication; 2) for the second order: gender hearing notice, gender medical affidavit, gender petition, and gender judgement. NOTICE: NOTHING IN THE TEXT SHOULD BE CHANGED EXCEPT FOR THE PARTS THAT REQUIRE A COUNTY, A CITY, A DOCTOR, A NAME, OR OTHER PERTINENT PERSONAL INFORMATION.

I know this is kind of a stale topic, but I wanted to toss my two cents in here.  I went to court today to attempt the same thing Ms. Glistenburg had done.  I won't bore everyone with the details here (I just posted a lengthy blog entry here with those:  https://www.susans.org/forums/index.php/topic,150155.0.html

Suffice it to say, other than the fact that I chose to use an attorney (mainly for my own piece of mind); it appears that I've had the same success.  I have my name change order in hand and the paperwork to send to the state to change my birth certificate.  I will have my gender change order in 30 days - we filed a single petition with both, but the judgments will be 30 days apart - it simply saved me paying for two filings and going to court twice.  So it definitely is possible to get a gender marker changed in Missouri without actual surgery. 

Many, many thanks to Ms. Glistenburg for her sharing this as I never would've pursued this had I not read about her success and the documents she provided were incredibly helpful.

This topic isn't too stale for me to add: I have processed marker changes in Missouri pre-op for Passport, Social Security and Drivers License, in that order using the new passport as proof of birth. I am scheduled to have a little work done next year, so I'll take care of the birth certificate then. I do not have any type of court order to make the gender changes that went through, just my explicit letter of treatment from my primary physician. My doctor's letter was prepped in accordance with the NCTE model letter.( Sorry no links from newbs, see paste below)
It should also be noted that the MO-DMV is under recent orders not to retain records. In short after scrutinizing my letter, they made the changes in the computer and I'm on my way with no further record in their system. This is good rather than a file stuffed with judgements, records and such.
There could be utility in having mismatched documents depending on a particular individual circumstances, though that's not for me.
It has been my assumption the a court order will be required to update my BC pre or post-op. Though I will inquire if the division of vital records will work with a surgical record, combined with my doctors original letter.

I have a doctor/patient relationship. (The letter must indicate that the physician is either an internist, endocrinologist,

So, Missy, are you saying that you took the letter from your Dr. stating you had clinical treatment sufficient to change your gender to the DMV and they took that for proof of gender change on your license?

I ask, because I have that letter already signed by my primary with letterhead and all of the trimmings.  I am going to court for a name and gender change in Missouri on Monday 10/20 and hope to come out with a judgement for my name and gender marker change.  I did not do self representation, I paid a lawyer to draft my petition and represent me in court.

I will let you all know how it goes, but I was wondering if the Dr. letter alone sufficed for you to get your license changed...?

I used my passport. Which had been changed via the state department update. I also took the Letter in. The license was updated at that point.

In a seperate (active) thread I have been talking about my current court case in Missouri to update my birth certificate. The Birth certificate update requires SRS, a name change AND another court order. That case should wrap up Friday. The Missouri department of health is in fact sending their lawyer to my hearing.

I see.  Good information, Missy.  I was born in New Mexico and they require surgery, so I am waiting until my breast augmentation next month to tackle that document change.

The judge signed my name and gender change judgment this morning. yay!!  So, I can at least take that and my Dr. Letter to the DMV and change my name and gender marker on my Missouri driver's license, and start rolling with the other document changes throughout my life.  I am elated to have gotten thru this.  He did question what authority he had to amend my gender marker.  My lawyer said it was so I can amend my birth certificate and that she had other's signed in the past in that courthouse, and he immediately said, "well, I signed it anyway, so OK."  She said that this judge had actually signed them for her before, but she didn't want to bring it up and piss him off. LOL

Good luck in St. Charles!  My wife is from St. Peter's and I used to live in St. Charles (when I met her....25 years ago!).  I hope it goes smoothly for ya, girl!

If you follow all of the instructions at http://transascity.org/missouri-transition-information/ Missouri revised statute 193.215(9) is void. :)

Well, I got my judgment today signed by the judge for name and gender change.  Went straight to the Missouri DMV and walked out with a new license bearing my new name and noting the Female gender!  All done pre-op.  Didn't even ask for a letter from a Dr. with the court order.

I was born in New Mexico.  They require a letter from a surgeon stating my sex has been irreversbly changed by surgery.  I am having breast augmentation done in 3 weeks, so i am literally sitting my plastic surgeons waiting room to hopefully get him to write just such a letter after the BA.  :)

Ah, my first setback in this whole process.  Denied by my plastic surgeon for a letter stating " that the sex of an individual born in this state has been changed by surgical procedure" (as New Mexico requires).  He was "not comfortable stating that because a BA is reversible and not changing the genitals".  Seems like an uninformed opinion, as BA is considered to be gender confirming surgery by many in the medical field.  I am going to try my court order and primary Dr. letter on the registrar of vital records in NM.  It's worth the $20 to take a shot.  All they can say is no. :)

I was born in Missouri, but now live in California.  I wonder if I send the letters with a court order from California, if they will change the Birth Certificate, or will I have to file in Missouri?  Thank you.

Good question.  I tried my Missouri court order in New Mexico and they denied it until I had a letter from "the attending physician indicating that the sex of an individual born in this state has been changed by surgical procedure".  So, it would seem that a court order from another state may not suffice.  But, hey, it's worth a try, right?  You can't win if you don't play!

Thank you for the reply Ainsley.  If I'm not mistaken, I believe that NM still requires the GCS/SRS of some form, while CA and MO no longer require it for the gender change.  So as you say it's worth a shot.  I might call the Bureau in MO...  again it's worth a shot.
