This person I found out sent a email to a third party who has been trying to mediate this claiming that he has always owned this site, and that is not the case. I am on the verge of filing criminal charges.

Hi. Looking at your Whois data, I can tell you that "
Domains By Proxy, LLC" isn't a person but a company owned and operated by
GoDaddy.com. Their sole purpose if to protect your identity, physical credentials, physical street address and personal contact details etc. Are you sure you didn't activate a privacy guard feature on the domain register? If you did, then this would happen.
If you have the transfer authorisation code for the domain, you can always unlock the domain from your registrar. Find another domain registrar, such as tucowsdomains (
http://www.tucowsdomains.com/) then transfer the domain over and and re-establish additional security features.
If someone has "hi-Jacked" the domain, it's not showing up on the whois records as it's been made private.
