Changing your name & gender on your passport

My roadblock is intransigent New Jersey Vital Records.  They are demanding that I change my Birth Certificate to reflect name and sex change despite Passport Office only requiring old Birth Certificate because my legal papers document my legal name and sex change.

Passport Office told me that if NJ refuses to issue BC, then they are required to issue a detailed statement why not.  NJ also refuses to issue that letter.  Thank you, Gov. Christie?  Nice group of state workers there.  NOT!

My problem is an adoption issue and a 'sealed' file at NJ.

You were told wrong about needing your birth certificate changed. I was able to change my passport without changing my birth certificate. In fact my birth certificate (TN) can't be changed even after SRS because TN is one of the few states that will not change the gender from transgender individuals and the only state that has a law on the books that states that the gender on a birth certificate can not be changes to to sexual reassignment surgery.

I would go back to the passport office and bring a copy of this:

from the state department's website. It's the procedure they are required to follow. Note that the letter must be formated a specific way (the same requirements for social security.)

I turned in the paperwork this afternoon at my local post office.  They accepted my "certified court order" for the name change and my Dr.'s letter (from the VA a US Govt. Agency which affirmed my gender change and stated ""she has completed the transition to the female gender."  They also wanted a copy of my drivers license (which I had changed that morning)   however,  my new drivers license still shows male,  as they wouldn't change the sex on it without a court order. We'll see how all of this plays out when I get my new passport in a few weeks.
