Neighbor keeps harrassing me

I have a neighbor that harasses me a lot and can't stand it.She always yells out offensive words when I go out to get in my car when I am completely dressed as Tori.I have had the cops come out and they sometimes do nothing calling 911.It went to court about several times and judge keeps throwing it out.We have encountered each other once so far and was not good.Did attempt to punch me when it happened.I am seeing a lawyer on this and she is not too happy seeing the cops not doing much and it being thrown out of court by the judge.My wife Renee goes through it also and she has had enough of it,seeing her lawyer on this too.My wife and I need this to stop

I wish I could say that you had more options than moving, but if the cops and courts are not protecting the rights of both you and your wife than I would recommend moving to somewhere else. I'm sorry that your having to go through that. It's not right that they are treating both of you that way. I hope the lawyer can help you. Still make sure that anything is against the law including assault you report. It so important to have that evidence when dealing with the lawyer because it gives you a leg to stand on. Hugs

Your wife has the right idea.  Not all speech is "protected speech" when it comes to harassment.  That sort of speech is not used for the intent of communication nor expressing themselves other than as a weapon to harm others.

There are many conflicting precedents set for situations like this so it's hard to know until you "lawyer up".

Luckily I have my other neighbor James and his wife Hannah whom we get along with very well as witnesses,they witnessed her harassing my wife and I.They are also fed up with it and on our side of this.My lawyer said don't take the law in my own hands which I have not done at all.Good thing she is about to get evicted,her house is about to get repoed.Learned she owes money and over 3 months late on her house payment.

Sounds like your problem will be solved soon but I would consider recording video when you think she might be harassing you. If you have a smart phone, just have it ready should she start acting up. Now the years have built some pretty thick calluses on my emotions but I might respond with something like "Isn't it a fine day and how is the family?". Use the line at your own risk.

Can you record her on your phone?  Just turn on the mic right before you walk out the door.  In most jurisdictions, only one party to a conversation needs to consent to having that conversation recorded.  And if she's just yelling at you, then she has no reasonable expectation of privacy.

Started video taping it on Monday and we don't talk.Had her arrested tonight,had her bedroom window with a bb gun pointed at me also harassing me.It was video taped and did shoot at me.I went down to the floor with the bb missing me and now a window has to be replaced.

This is very important.  Now that she has been arrested, you need to find out who specifically is prosecuting the case (district attorney, city attorney, county prosecutor) and talk to the specific prosecutor assigned to the case.  Make sure they know that you want a "stay away order"  as well as a "do not harass, annoy, molest, stalk, etc. " order as part of the plea bargain or the sentence if there is a conviction.

If she gets probation then that kind of order is good for the duration of probation, or if she gets jail or prison with no probation the order is good for five years in most jurisdictions.   Any violation of the order is a new crime, meaning you can get the police out there immediately and have her rearrested if she does anything else.

Talk to your lawyer about the particulars, and how criminal protective orders work in your jurisdiction.  Protect yourself and be well.

The prosecutor saw the video of the incident with the bb gun,charged her with discharge of a weapon and she plead guilty to it.Sentenced to a year in jail,judge saw her long conviction record.My lawyer said get the stay away order.Plus she has to pay for the new window ordered by the judge.

What a difficult situation!  Its been awhile since you posted  so hopefully things have been resolved.  If not, you might want to consider installing some small surveillance cameras.  You will want to have a record of what ever transpires.

One advice I'd like to add: don't let her think she's gotten to you. Just like Internet trolls, scumbags like her tend to thrive when they see they can get a rise out of people. Be calm in all future interactions, and she might get bored eventually (until then, you can collect evidence for a restraining order or whatever).

I don't know if this is a good Idea but maybe set her up fix up you're garden or lawn while dressed up she will harass you and get it on film take it to Court

She is long gone and lost her house.Great thing is I have great new neighbors that bought the house and respect my lifestyle.

What state do you live in, hun?

There are ways around the cops and the courts doing nothing, depending on how aggressive you want to be.  yes, I said and mean aggressive.  Too bad you're not down here in Alabama - damn if I'll let one of my sisters get pushed around.

Make sure that you keep a running log of every encounter with her, and make every effort to tape the encounters as well.  Sounds to me like your civil rights are being violated big time - see where I'm going with this?

Do you have a municipal police department or does the Sheriff's Office have jurisdiction where you live?
