Eleven states and state officials filed a lawsuit Wednesday challenging the Obama administration over federal guidance directing schools to allow transgender students to use restrooms and other facilities that match their gender identities.

The federal lawsuit, filed in the U.S. District Court for the Northern District of Texas, states that the guidance "has no basis in law" and could cause "seismic changes in the operations of the nation's school districts."

I knew there would be backlash, but this is big.

I hope and pray the transgender children of America are not about to get crushed.

Maybe I'm just bitter, but this makes me laugh, because I know they will ultimately be crushed because at least a few federal appeal circuit courts have already ruled in our favor basing their decision that such things violate Title IX of the Education Amendments, as well as stating it is a violation of Title VII of the Civil Rights Act, in regards to Price Waterhouse v Hopkins that ruled gender stereotyping is a violation of Title VII. It is sad because these frivolous law suits against Obama are a drain on tax payers, but such conservative ways are dying out and they will not win this one. And you'd think they would have learned from individual states having their same-sex marriage laws overturned and having same-sex marriage installed by the Supreme Court would have scared them, but apparently it didn't.

I wish I had your confidence that a bunch of cisgender judges many of whom were appointed by presidents that wish us ill will make the right decision. The first court that heard this issue in the Grimm case ruled that Gavin Grimm, a transgender boy, was actually female. A ruling like that would be a disaster for our community.

The other wrinkle is that for us to receive favorable court rulings, someone will have to defend them. Mr. Obama will be breezing out of town next January and there is no guarantee the next president will see fit to offer anything but a token defense, making it easy for the court to decree that we are forever and unalterably the gender that corresponds to our birth sex.

"NEW YORK — Eleven states have announced legal action against the Obama administration following the release of guidance on how schools treat transgender students.

James Esseks, director of the ACLU LGBT Project had the following reaction:

"This lawsuit is an attack from 11 states on transgender Americans, plain and simple. While the Obama administration is being sued, the real targets here are vulnerable young people and adults who simply seek to live their lives free from discrimination when they go to school, work or the restroom."
