The UK Sex Discrimination Act 1975 was ammended in 1999 to Include the Gender Reassignment Regulations 1999. It is ilegal to discriminate against a woman who either applies for a job or is passed over for promotion on the grounds of Sex. The Gender Rassignment regulations detail employees rights as a transitioning or post operative Transsexual in employment law.
As the Woman in Question has a Gender Recognition Certificate under the Gender Recognition Act 2004 and she is legally Female With a Female Birth Certificate, this is discrimination based on Sex as defined by the Sex Discrimination Act.
However if the employer feels her qualifications and skills do not meet the required standard than that is not discrimination.
