Has anyone applied for a CCW permit in San Diego County, and used their transgender status as the "Good Cause" justification?

If you did, were you successful?

And, either way, would you care to share anything about your "Good Cause" statement that might be useful to someone following in your footsteps...?

The way California law works, it's up to the sheriff (I think) if you get a CCW. In Los Angles it was nearly impossible to get a CCW but out in San Bernardino County you could get one just by asking. I know because that was how my roommates son obtained his. If your in one of the more difficult counties you will need a reason why you feel you are at risk in public and it may have to be a very good provable reason. Because the decision is decided by an official who may be changed out at the next election, answers from people who obtained CCWs in the past may not apply.

All true, Dena. Sherriff Gore in San Diego County has been here a long time. And generally, his position is that law enforcement is able to protect the general public. His position is that unless you are, "more at risk than the general public," you do not get the permit.


It seemed to me that the non-passing set of us especially, are more at risk than the general public.


So, I was wondering if anyone has actually tried this argument for the panel Sherriff Gore uses to decide.

I have had my share of rude and occasionally threatening comments. I expect most of us have. So, it seemed like it might be a reasonable justification. But perhaps in reality, for San Diego, it is not.

May issue states are tough. I got my first CCW in NY at 19. To and from the range and hunting only. Moved to Iowa and that was a May issue state when I moved there, but the sheriff had a shall issue mindset. Iowa later became a shall issue state. AZ is shall issue and has a constitutional carry. No problems here. I suppose you could apply anyway and see what happens, move to a county more favorable, carry anyway in violation, but protected or maybe have some sort of dual residency in another county that's more favorable, maybe even for business reasons. Another thing to consider is asking a state gun rights org their opinion or advice or if they know a lawyer that can advise you. Also, consider getting insurance if you do carry so it covers legal fees and loss of income in the unfortunate event you have to protect yourself. I pay $30 a month and I'm covered for over a million dollars total. Some time in a previous life, I worked for a bail bond and had to go to some choice places in NYC. Nearly impossible to get a license there(licenses from other NY counties aren't recognized by NYC) so... anyway, I'm sure you will find a option you can live with and hopefully you'll find a lawful way to protect yourself. Let us know what you find out.

The documentation in the case Peruta v. San Diego County will probably be the best description of the state of CCW in San Diego County.  For a short period of time between appeals decisions, San Diego was supposed to err toward shall issue.   The current standard is apparently back close to the restrictive good cause it historically had been.

The well connected may have an easier time showing good cause.   The numbers above suggest it may be an involved process to obtain a CCW permit in San Diego county.
