SD Attorney General Marty Jackley signals support for Ten Commandments displays in schools

South Dakota Attorney General Marty Jackley announced Monday he supports a Louisiana law that's similar to a proposed South Dakota bill to require the display and curricular inclusion of the Ten Commandments in schools.

Jackley, and 17 other attorneys general, signed an amicus brief showing support for the law requiring all K-12 schools and state universities display the Ten Commandments in classrooms. A federal district court has blocked the law from taking effect after the Louisiana Legislature and governor signed the law. The attorneys general filed their brief in late December.

Jackley's spokesman Tony Mangan said while Jackley supports the concept of the Ten Commandments display in public schools for the releases mentioned in the release, he hasn't yet reviewed South Dakota's version of the bill.

First-term Republican Sen. John Carley, from Piedmont, sponsored Senate Bill 51 last week. Its first hearing isn't yet scheduled. The legislative session begins Tuesday.

-----------------------

My objection to this has nothing to do with religion, although I question what happened to what was once referred to as the "separation of Church and State'.

My objection is instead, that once again, State Government officials in South Dakota are more concerned with issues outside of their jurisdiction.

During the COVID pandemic, while South Dakota businesses were closing up (some permanently), and citizens were out of work and hurting financially, our Governor, Kristi Noem, was busy traveling all over the country to various states to Trump rallies. She denied her citizens COVID Relief Funds while making sure that her family received $500,000 of the same.

Governor Kristi Noem ordered the State's National Guard troops to assist Texas with border patrol duties. It is none of South Dakota's business what Texas is doing, and there are plenty of things that the troops could do here at home, but her actions endeared her to Mr. Trump, who has since nominated her to Director of Homeland Security, where she will oversee Customs & Immigration and Border Security at the Federal level.

Now, we have Marty Jackley expressing his opinion about an out-of-state law, while at the same time "hasn't yet reviewed South Dakota's version of the bill." A law that no one asked for, by the way.

Maybe someday an elected official will actually represent the people who elected them.

They are trying to do that here too. This legislative session is just going to be another ->-bleeped-<- show like the last.

See what is known as the Establishment Clause in the 1st Amendment.

Amendment I

Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.

There have been many interpretations and applications in law and court rulings as to what the  Establishment Clause allows, limits, or forbids.  The same applies to the rest of the 1st Amendment.

Should the US or any State government force us to follow a preferred religion? Thou shall not...

The phrase doesn't appear in the Constitution but comes from a letter Jefferson wrote in 1802 regarding the First Amendment. That letter has been used over time by the courts to determine what the Founding Fathers intended. It has generally been accepted to mean that the State may not impose a State Religion, nor interfere with any citizen's right to worship as they choose. However, after Madison left the Presidency, he called for a "total separation between Church and State", even though he and Jefferson both attended church services at the Capitol.

My opinion is that if we are to allow the display of the Ten Commandments in school classrooms, then there must also be an equal display of texts from other religions as well. If the purpose is not to impose a "State religion" but merely for education, then the display of other sacred texts must also be displayed for the same reason. Failure to do so is a form of religious discrimination and is illegal and unconstitutional.

For those who wonder what that exact wording of the actual 1st Amendment is, it can be found online.

I am not expressing an opinion of what is a correct application of the 1st Amendment.

You have a First Amendment Right to express your opinion about it, Chrissy!  ;D

True, but I did not express and have no desire to express my opinion on it, as I presented only facts.

However, at other times, I do express an opinion.  You do perhaps a lot more than me; but, I guess I do not for one reason or another.  It must just be part of my personality.

Here is an opinion:  You are sweet and deserve many niceties in life.

Chrissy
