Extra charges in transgender murder possible
Greeley Tribune
Published December 31, 2008 at 12:05 a.m.

QuoteThe Weld County district attorney moved to increase a potential sentence in the murder case against Allen Andrade, 32, of Thornton, by filing habitual-criminal charges against him.

In this case, the habitual-criminal status guarantees a sentence of four times the amount of the sentence of the convicted crime.

Andrade is charged with first-degree murder in the death of Angie Zapata, 18, a transgender woman who was biologically male.

Zapata was found dead in her Greeley apartment July 17. She had been beaten with fists and a fire extinguisher.

Andrade is charged with first-degree murder, a bias-motivated crime, felony motor vehicle theft and felony identity theft.

Habitual-criminal charges? Is that due to his past or this incident? It doesn't seem right if it is due to the several charges in this case against the cross dresser, not the "transgender woman who was biologically male." When is Rocky going to get it right?

Man accused in transgender death faces new charge

QuoteThe man accused of killing a transgender woman in Greeley this summer could likely face extra time if he's not convicted as charged.

The Weld District Attorney on Tuesday moved to increase a potential sentence in the murder case against Allen Andrade, 32, by filing habitual criminal charges against the Thornton man. In this case, the habitual criminal status guarantees a sentence of four times the amount of the sentence of the convicted crime.

Andrade is charged with first-degree murder in the death of 18-year-old Angie Zapata, a transgender woman who was biologically male. On July 17, Zapata was found apparently beaten to death in her Greeley apartment, after her attacker apparently learned her secret. Police say Andrade beat her with his fists and a fire extinguisher, blows from which she subsequently died.

Sounds like the DA is grasping at straws...Let me get this straight; Andrade is going to be punished for being punished, right?? I can see how possession of contraband and lying to a pawn broker can get you a life sentence. (Even if you've done your time.) This is so pathetic. Those felonies have no bearing on this case. And I say, grasping at straws because of the nullification aspect of the case. All it takes is ONE person to see that BOTH men where in the wrong. If you sit in on the jury, and if you're blogging about it, you can't, remember that the DA wants to quadruple what you give him. Keep that in mind.

QuoteMr Andrade's jury trial is scheduled to begin on April 14. Should Mr Andrade be found guilty of murdering Angie Zapata - of bludgeoning her to death with a fire extinguisher and leaving her for dead on the floor of her own apartment - then I hope the court will reach a verdict which adequately reflects that fact.
