I'm still living in my marriage, though I plan to get out and get divorced soon. But for the time being, I'm stuck here. I'm fully transitioned, my gender designation is Female with the DMV and Social security. We don't have money and are going to apply for food stamps. We live in Virginia, which has a constitutional amendment banning same-sex marriages as well as any of the benefits of marriage for same-sex couples. But my marriage was legally valid before I transitioned.

So what do I put on the food stamp application, and what will be the reaction of the state?

If I tell the truth and say I'm her spouse, the system will kick out an error: Two women married? Bzzzt. FAIL.

If I lie and say I'm not her spouse, our application could be denied for giving false information... FAIL.

If we lie by not listing me among the residents of this household, they require information on the whereabouts of an absent spouse. But I have no residence but right here... FAIL.

Is there any way for a transsexual same-sex marriage to come up with anything but FAIL on this? What does the state actually do with couples like this?

You was not the same sex when you were married so that still holds. They might ask to see you court order name change.

They ask for the gender of each individual. Two females as spouses... I wouln't be surprised if they have their computers programmed to kick out an error message automatically.

I need to know what has happened with other couples in this situation.  By now most states have such anti-SSM benefits legislation.

i know in the state of ohio they ask for copies of your drivers licenses, ss card and birth cert. and in ohio they dont change the sex on the birth cert. i dont know about Virginia and the information they need but i would put female and provide a copy of your marriage license and the original birth cert that states you were male.

Mickie, I have the misfortune of being born in Ohio too. My feelings about this are unprintable in a family forum. It goes beyond BCs too. When I got my student records from Kent State updated, they said because of Ohio state law they're not allowed to change gender there either.

so then i would not worry about being denied food stamps because if you were born in Ohio they will always see us a male even though we are females. and a while back my wife talked to a lawyer about our marriage and being still legal and he said as long as you concemated the marriage its still legal, and i am sure that you will be able to get food stamps since you were legally married before you transistioned. i would just go a head a apply and have a good lawyer on hand in case you get denied. LOL you seriously don't know a lot of the people here in Ohio then do you, Miss Bev? people here are seriously inconsiderate when it comes this. Ohio is the most transphobic state to date, and most of the republican government officials and religious people would rather commit genocide on our kind. haven't you read my posts about the way they treat me at Cabal-mart?

No, I don't know many people in Ohio.  I'm sorry, but I have not read many of your posts, but then, I usually don't spend as much time here as I used to.
And about your employment?  They probably don't treat you much differently than I'm treated at Sears.  Have you been terminated by a bigot yet?  I have, at wonderful Sears, then fought my was back legally, because I'm an old gal and need the work.

If I lived in such a state, me, my honey, and likely our kids, would all move to another state.  There are othersupposedly diversity-mandated Sears stores in every state.

I talked with Mara today, and she says I have to apply as a married spouse. As for the same-sex matter, she said they may or may not make a problem of it, and if they do, just explain that I'm trans and the marriage was legally contracted before my gender change, and that's how trans people handle these situations. So I guess that answers my question.

Appy separately, on different days or offices. It's a gov't office, they are screwed up anyway. As to the m or f thing on applications, I fill out most everything but that. The clerk reads it, usually looks at me and checks m for me. Always, assigne yourself your choice. A valid form of picture i.d. is helpful.
