I am living as male full time and my psychiatrist denied the letter to change the sex on my license.
The story behind it is that my lcsw wrote me this letter http://i1036.photobucket.com/albums/a442/kylekckacey/maleletter_edited-2.jpg but it wasn't accepted by the dmv because it has to be from an MD or Phd. So I asked my psychiatrist to do it and he said no. He gave like 3 different stories.
1) Im not stable enough as he told my mom but denied to me that it had anything to do with that
2) He doesnt want to get involved.
3) He beleives I should have surgery because now it would be a lie and my license must say female.
He denied me despite having all the requirements I need and that I am ready. Could I sue him for wrongfully denying me treatment?
I probably wont though. I fired him and Im looking for someone else.

No it's his professional opinion and he would easily defend any legal suit. He also has medical defense insurance and you don't.

Find another as the others have said.

what are the requirements for changing just the sex marker on your license? just a letter from a doctor?

he might've been confused since to actually legally change your gender you do have to have surgery (at least that is true in Japan and I think a number of US states)

I recently saw an article from the US department of state about the new requirements to change the gender marker on US passports. You need to have a letter from a physician saying that you have undergone "appropriate clinical treatment" for the transition (very vague if you ask me), and they can issue a limited validity passport if you get a letter saying that you are in the process of undergoing treatment for a transition (also very vague).

I know that driver's licenses are controlled by the state you live in (if in the US), so that may be entirely different.

The most you could do to this person is file a complaint with your states medical board...

Sure, you can sue him/her.  You can always sue someone.  Question is, can you win?  Answer, highly doubtful.  They can always pretty much say: I was trying to err on the side of caution.

I got my GP to sign the DMV paperwork, but that was in California.

My endo kept checking the box for a temporary gender change on my license, even though he promised that he would mark it permanent as soon as I had my top surgery. After my surgery, he did this two or three times. I finally got sick of it and went elsewhere.

Oh, and in CA, the recommendation has to come from an MD (not a PhD) if you want a permanent change. So I never asked my therapist at all.

In my state(New york) you have to have a letter from a doctor saying you are living as your target gender full time.

Oh, and in CA, the recommendation has to come from an MD (not a PhD)

but she says the person is a psychiatrist, and a psychiatrist is an MD.

Sorry I wasn't clear--I was just explaining why I didn't ask my therapist. When I griped to my trans friends about my endo's obtuseness, practically every single person asked, "Why not ask your therapist?" I figure if a bunch of CA trans guys don't know how the gender change works in CA, then someone from another state almost certainly won't know.
