A transsexual who downloaded child pornography has been spared jail after a judge said that time in prison would be an "appalling experience" for her.

Laura Voyce, 20, who has changed her name from Luke, could have been locked up for nine months after being convicted of 14 counts of downloading indecent images of children.

But Judge Lesley Newton chose to suspend the sentence after saying that she would be at risk of attack in prison.

Voyce, from Kirkby in Merseyside, is in the process of having a sex change to become a woman.

The court heard a stash of indecent images was found on Voyce's computer by police investigating another allegation.

If they downloaded kiddie porn on purpose... and 14 counts sure sounds like something someone did intentionally, they should rot in jail... stick them in solitary.

There is clearly more to this story that meets the eye.

Having siad that, the problem of the law and child porn, in the UK is in a mess since a number of socially prominant people were caught out.

Gary Glitter, a glam rock pop star from the 70s who was making a big time come back, was caught, sent to prison and ultimately ruined. Since then, lurid stories have popped up about him with the theme, 'It was obvious all along'.

Following this a campaign was started and police set up a special task force to look for child porn. They traced it from sources to computers. They took reports from people.

A few more cases emerged, some carrying bigger sentences than Glitter.

Then some judges, few police and then shock horror, Pete Townsend, he of that pop group. The Who, who had been generally regarded as almost an elder statesman.

Here in the UK, it just isn't done to put respectable people in with a lot of rough, criminal class type, don't you know? Eh What!!

So, the defense of, 'I only downloaded it for research purposes', came out. Townsend claimed he had been abused as a child and was writing a book about it. This same defense has been repeated so often.

The full details in this case are clearly being pushed aside by the transgender nature of this criminal.

The law is a mess. The realities of child abuse cannot be fully discussed.

I was aware that in the UK a Gender Recognition Panel could issue a certificate to a preop transwoman,
that would designate her legally female, for identification, and other purposes.

Indeed there are many states in the US that will do the same.

However, in both instances it was my understanding that a woman would be incarcerated based upon her
genital status.

Thus a pre operative transwoman would be interned with genetic males, and a post operative woman
would be interned with genetic females.

From the citation below it appears as if where a preop transwomen is incarcerated is dependent upon
a decision by the Prison Services.

Whoever said that doesn't know what he's on about.

I could go into the ethics of mental health but suffice to say, GID isn't an illness because it isn't, in itself, a problem.

The unnatural attitude toward children is. But treatment for that is hampered by a number of factors, not least finding anyone prepared to give it.

This should not be hard one:
- she is legally female
- she possesses still external male genitalia
- she has done a serious crime

Conlclusion: She should be put to female prison and there to solitary or partial solitary. That would not be so hard just one pre-op transwoman won in the court to transfer to female prison because of her gender recognition certificate.
