I know that a precedent has been set for this, as a TS woman won her case against the IRS allowing her to claim her SRS expenses as a deduction on her taxes.

I've even had a brief conversation with someone local that they and their partner claimed it for their surgeries, and never heard anything challenging it.

I'm curious if anyone has experience doing this, as I would like to claim it on next years federal tax form.

I think it's the same question but asked in a different way.

Has anyone used their FSA (Flexible Spending Account) to pay for SRS?  I believe it's the same tax code.  If you can use an FSA then it must be deductible.

How about any other services like blood work, hormones, doctor visits...

Sort of a tax decuction.
Ive just had $40K of personal tax released from the Australian Tax Office. The girl over the phone actually suggested applying for release when I told her I couldnt make the repayments and told her about my situation.

Mmmmm now to save some money and buy a house lol

I itemized last year and wrote off therapy, insurance premiums, copays, endo visits, testosterone, top surgery, and mileage. Only a portion of the expenses could be written off, but it added up. Haven't heard a peep from the IRS. And it kept us from being taken to the cleaners after my &^%^** ex forgot YET AGAIN to adjust his withholding. Talk about passive-aggressive. He's only "forgotten" for three years running--and it looks like we'll be filing jointly again for 2010 because our divorce won't have gone through. I pray that he finally adjusted his withholding. Now that we're separated, why should I have to pay for his lack of planning?

Gah. Sorry about the rant. He's okay in most ways, but not this one.

I claimed my surgery and electro as an itemized deductions, received it, and the IRS hasn't audited me yet.

I have my documentation and I'm ready for them if they contact me.  And they will, I'm sure.  Precedent has been set in tax court so I'm confident I would win if they contested it.

I had my surgery prior to the precedent setting RHIANNON G. O'DONNABHAIN, Petitioner v. COMMISSIONER OF INTERNAL REVENUE,
Respondent, Docket No. 6402-06. Filed February 2, 2010.

Additionally as my GRS was performed in Thailand, I would have been disinclined to file. However, had I had my surgery more recently,
and performed domestically, I most definitely would have filed for the deduction.

Just fyi...the IRS has many years to decide to audit your deduction ...they are quite overburdened right now and often times you are not audited because of good fortune.  When your tax return NEXT year shows much lower deductions, it may get flagged by the computer and they may go BACK and look...

all i'm saying is be careful with your budgeting and understand there is a risk for a number of years...i was recently audited for 2007..so i know...

good luck...btw... i had my surgery this year, and I plan to deduct it!

all the best

I claimed top surgery with no problems, and plan to claim SRS this year ($17000).
