Job Question?

I have a question.
I am starting to apply for jobs, but I don't know if I should put my gender down as Male or Female?
I am Pre-SRS and Pre-T.
I am an FTM.
My mom says I need to put down Female, but I am so confused on this.
What are the laws regarding this?

I think you might have to put down what you legally are, since payment can only be done under your legal name and social security #. But I'd like to know how to handle it myself.

Before it was changed I put down M, cause I'm stubborn. If its the correct SS number and you put down your legal name, everything will still be fine.

Although this may have worked for you, it is not necessarily true. If they decide to enter your sex when running your SS number (to the best of my knowledge, not all places do this but some do) you will get a no-match letter because the sex they entered and the sex linked to your number are not the same. You should either enter your legal sex and explain it later, enter the sex you identify with and explain it before they run your number, or (if filling out a paper application or an electronic form where it's optional) leave it blank and explain it later. I would not suggest relying on them not entering your sex when checking your SS number. It sucks, but if you want a job you have to make sure that they can run your number properly.  :(

I'm not sure, but I suspect that most places where I live do not run your SS# here, and I know they never call references or past employers. So I've always thought that this is the information they look for on applications here:
1. Your gender. Men, OK. Beautiful women, OK. Plain/ugly women, NO WAY!
2. Your last name. Who are you? What ethnicity is this name? Because if I can't tell it's German/Italian/Polish/Ukrainian/or whatever, then you're just poor white trash who'll steal from me and spend your paychecks on crack & heroin.

Yeah, that's what I figure matters here. So that's why I've always thought if I could put down a male name, I'd have more of a chance.

I'd count on almost any real job not only running your SS and checking your employment history, but also doing background and credit checks.

When I was pre-op / pre T, I just left it blank. Never had a problem.

Vince- in all of the job apps I've seen the place it asks for sex/gender it's asking for tax credits and it's optional, you don't have to answer so you can leave it blank. Otherwise if it's asking it then sorry but I'd put female. You don't want to come off seeming stubborn or maybe leave it blank. Sadly your mom is right because they are going by pre-T pre-op stuff.

Well, I'm legally male, but SS refuses to change it on their records until I have surgery. I have a job now and all my tax crap went fine, I work in an all male factory and I'm pretty sure they wouldn't have sent me there if anything odd came back with SS.

In my experience:

It is optional to declare your sex a lot of the time on applications. However, as some members have pointed out, they may need to know birth sex for documentation purposes.

What I mark on applications largely depends on the wording of the question. They will of course find out I'm trans regardless - when they do a background check my name change will come up... but if the question asks for "sex" I will mark F. If it asks for my "gender" though, I put M. If they don't like it then they didn't realize what they were asking. Not my fault you don't know the real meaning of what you put on your forms, lol.

I agree with Randy. If it asks for "sex", I put female. If it asks for "gender", I'd put male. But from my own experience for applying for jobs, most of the time they don't even ask for your sex/gender, and supposedly it's discrimination based on sex/gender if they do ask, so that's why they don't ask. I don't know if this is true for everyone, but that seems to be the case where I live.

Well, on your license it says sex...and mine says M...even before it said M....I put M. Sex, gender, Screw the terms. I don't care what it said, before it was changed, I still put M.

You need to put down the gender you are on your Driver's Licence and Social Security. Most employers will make a copy of your DL for their files. Also, if they check your SSN and the genders don't match it will raise a big red flag. They could be concerned you stole someone's identity. At any point they probably wouldn't hire you or will fire you because you lied (in their eyes).

It sucks, but until the gender is changed on your DL and with SS you'll be outed to an employer. That's why I waited on my job search until I had those changed. You can just tell them you're transgender, want to be known as male and hope they don't talk.

This raises another issue; what do you do if your DL and SS don't match? In Indiana (and possibly other states) you can change your DL with a letter from a therapist, but SS requires surgery. You're screwed either way. Life is tricky.  :(

I don't know the legality about the answer to this question.

But since I'm pre everything right now,
I scribble in another box and write 'sex' and put an F in it, and next to the gender box, I fill in M.
When interviewers ask, I tell them, and I usually tell them during the interview too, I'm not willing to lie at work anymore.

Well, my gender isn't changed with SS til surgery, but its changed on my license. As I said before, I work in a male only factory, and I highly doubt that the temp agency would've sent me there if something didn't match up.
