Trial set for January after federal judge rules privacy claim can move forward in court

Skye Wyatt

TYLER — Before Skye Wyatt's softball coaches outed her as a lesbian to her mother in 2009, she was a straight-A student who loved going to school, Wyatt alleges in court documents. But after coaches Rhonda Fletcher and Cassandra Newell locked Wyatt in a locker room on March 3, 2009 — where they allegedly threatened and interrogated her, before kicking her off the team and outing her to her mom — Wyatt said she became depressed and anxious.Last month, U.S. Magistrate Judge John Love, of the Eastern District of Texas, denied the defendants' motion for summary judgment in the case, which is now set for trial in January.

Krause said it marks the first time a court in the 5th U.S. Circuit — which covers Louisiana, Mississippi and Texas — has identified a constitutional right to privacy for sexual orientation information.

"It's one thing to say that conduct by LGBT people can't be criminalized under the Constitution," Krause said, referring to the U.S. Supreme Court's ruling in Lawrence v. Texas, which overturned the state's sodomy ban. "It's another to say there's an explicit constitutional right to have information about sexual orientation be kept confidential."

I will follow this case as much as possible. These coaches put Skye's life in danger by what they did. They lied to her teammates and has cause a rift in her family. Skye has a right to be who she is whether or not anybody likes it.
Be who you are.
Make a difference by being a difference.   :)

And if that wasn't enough...

I posted this article because of the legal issue of privacy. This may very well go down as a landmark case concerning  a constitutional right to privacy for sexual orientation information.

Think about it...

Their behavior was disgusting and totally unprofessional. Regardless of the facts or their feelings, to betray the confidence of a student in this way beggars belief.

Here's hoping these two go to prison where they deserve to be. They certainly should never be allowed near children, ever again.

True, True...and possibly a Civil Lawsuit against the school also.

But keep in mind that an important issue is at the center of this...privacy! The we in the LGBTQI have a right to privacy about our "orientation". If anyone has heard of this type of case before, please post whatcha know...

Every student has a fundamental right to privacy. No matter what the issue.

I sincerely hope that anyone whose privacy has been outed or exploited by any teacher, will seek proper redress.

I hope she wins.

BUT - are all softball coaches absolutely straight heteros?

I didn't realise softball was so big in USA.

Our rounders is similar game played by girls only in high school.   never noticed it as an organised sport for any age in UK.

Seems this is yet another Texan lie.

Didn't happen. The student asked that her parent be told.

My apologies, I didn't notice the signifiance of Utah and picked up the wrong end of the stick.

But I wasn't attacking Texans, nor America, but rather dishonesty.

I confused the stories in this case and am very sorry
