A transgender San Francisco woman is suing Seton Medical Center in Daly City for refusing to perform breast augmentation surgery.

In the suit, Charlene Hastings, 57, alleges the hospital violated California's Unruh Civil Rights Act. The act, which prohibits businesses from discriminating against people based on their sex, race, sexual orientation and other characteristics, uses the state penal code's definition of sex. That definition includes gender identity."
