The ECJ ruled that, in this case, the EU's rules supersede national law.The case centered on "Shipova," a Bulgarian trans woman who moved to Italy, where she began hormone therapy. However, her request to change the gender on her birth certificate in her home country was rejected, which spurred the now-decided legal tussle.The ECJ ruled that Shipova had been exercising her right to freedom of movement and was therefore protected by EU laws protecting gender identity. Under the European Commission, all EU citizens and their families have the right to move and reside freely within member countries, a statute known as "freedom of movement."The judges ruled that the right to freedom of movement "protects gender identity and obliges Member States to provide for clear, accessible and effective procedures for the legal recognition of it," in a decision that applies to all 27 countries currently a part of the EU. The ruling continued, "The Court notes that the discrepancy between a person's lived gender identity and the gender data appearing on his or her identity card is such as to hinder the exercise of his or her right to freedom of movement."
