The United States' government is failing to comply with human rights obligations when it comes to LGBTQ+ community, according to an updated review recently released by The Williams Institute.
Highlighting the main issues at play, the researchers noted three key areas for concern: "discrimination, ill-treatment, and denials of protection for LGBT asylum seekers, refugees, and immigrants; government actions to exclude transgender people from public life, travel, and evidence-based health care; and the erasure of sexual and gender minority people from official data."
The Williams Institute, part of the UCLA School of Law, submitted a similar review in April 2025, and this week's release includes updates for the period from April 2025 to April 2026.
One of the main contentions in the review is around "the denial and revocation of gender-concordant identity documents." Noting the Trump administration's push asking the Supreme Court to allow its denial of updated gender markers on passports — and the eight states that have effectively made it impossible to update gender markers on driver's licenses — the review's authors suggest that both efforts violate the law.
