Shilling v. United States: The case we're a plaintiff in, filed here in Washington, remains pending.
Talbott v. United States: On June 1, the D.C. Circuit ruled 2–1 against the ban on Trans military service.
Trans Passport Ban Cases
Orr v. Trump: In November 2025, the Supreme Court voted 6–3 to let the State Department enforce its policy while the case continued.
Gender-Affirming Care: Provider + Patient Privacy
Seattle Children's Hospital v. DOJ: DOJ issued an administrative subpoena demanding patient names, dates of birth, Social Security numbers, addresses, and parents' information for minors prescribed puberty blockers or hormones—reportedly around 3,100 patients. In September 2025, Judge John Chun threw it out, calling DOJ's stated basis for investigating an "idle hope." DOJ is appealing. No records have been handed over.
QueerDoc v. DOJ: The Justice Department sent a similar demand to QueerDoc, a telehealth clinic. A second Washington judge threw it out, saying DOJ "issued the subpoena first and searched for a justification second"—meaning they went looking for records before they had a reason to.
Gender-Affirming Care: Bans + Coverage
Oregon v. Kennedy: In December, HHS Secretary Kennedy issued a declaration asserting gender-affirming care for young people isn't legitimate medicine, and threatening to throw providers out of Medicare and Medicaid. Twenty-one states plus D.C. sued—including our very own Washington state as co-lead, with Oregon. In April, Judge Kasubhai vacated the declaration outright and permanently barred the administration from enforcing it or anything like it in the plaintiff states. He ruled HHS can't unilaterally invent standards of care that override the states'. --------------------------------------------------------------------
