The Equal Employment Opportunity Commission (EEOC) – the federal agency tasked with fighting employment discrimination – has agreed to let some Christian businesses discriminate against transgender and nonbinary employees as part of a lawsuit settlement.

"This agreement provides meaningful protection for Christian employers who simply want to operate their businesses in a manner consistent with their faith," said Christian Employers Alliance (CEA) President Margaret Luculano in a statement. The EEOC agreed not to pursue enforcement of certain anti-discrimination claims against CEA members. "CEA members should not be forced to choose between following their deeply held Christian convictions and participating in the marketplace."

At issue is guidance from the Biden administration in light of the Supreme Court's 2020 decision in Bostock v. Clayton Co., in which the Supreme Court ruled that Title VII's ban against discrimination on the basis of sex includes a ban on anti-LGBTQ+ job discrimination. The idea is that it's impossible to discriminate against LGBTQ+ people without taking sex into account.

The EEOC in 2024 released guidance to employers on how to avoid discriminating against LGBTQ+ employees, which included rules about pronouns, forced outing, misgendering, restroom usage, and physical assault.

The agreement says that the EEOC will not pursue any charges against CEA members related to the organization's use of employees' pronouns, refusal to affirm a person's transition, implementation of dress codes based on sex assigned at birth, and discriminatory bathroom rules.

While the EEOC will no longer enforce these rules, trans and nonbinary employees who are discriminated against can still file lawsuits against discriminatory employers.

My simple reaction: Totally <beep>.

Maybe my reaction is too simple but allowing religious whatever to have precedence over actual discrimination, in a so called western/educated society, is something I have a bit of a difficulty to accept.

It can be noted that I am an atheist and that is of course affecting my views on everything religious.
