The Supreme Court routinely splits 5 to 4 on its decisions. Sometimes the winning side is progressive, and sometimes it's reactionary. But it's often 5 to 4.
The next President will appoint one and possibly as many as three judges to the Court. The most likely to retire is Ruth Bader Ginsburg, who is in her 80s and a two-time cancer survivor. She has been a steadfast champion of women's and LGBT rights. If a Republican appoints her successor, the tenor of the Supreme Court is about to change. Even worse if there are multiple appointments.
From a Court characterized by 5 to 4 rulings, some good and some bad, a Republican President may have the opportunity to change that to a steady streak of 6 to 3 rulings, all of them toxic. Future majority opinions involving LGBT rights may end up being written by Scalia, or Thomas, or Alito. This could have the effect of poisoning the US legal system for many years into the future.
